Mexican Mud Band Performance Agreement

This contract for the personal services of performers on the engagement described below, 
dated: ____________, between the undersigned Purchaser of Entertainment, herein 
referred to as the Purchaser, and The Mexican Mud Band, performers, herein referred to as 
the Performers Leader.

The performers are engaged severally on the terms and conditions of this Agreement.  The 
Leader represents that the performers already designated had agreed to be bound by said 
terms and conditions. Each performer, not yet chosen, shall also be bound by said terms 
and conditions upon acceptance.

Parsons prior to engagement

The Performer shall do everything necessary to prosecute the work in an expeditious and 
workman-like manner pursuant to the standards of the trade and all work performed will be 
in accordance with generally accepted trade practices.  The Performer shall perform said 
work at the time and place herein specified and will be punctual and will provide his own 
equipment for said work unless otherwise specified herein.  The Performer shall be 
responsible for payment of any transportation costs, material costs and fees for booking.  
The Performer will also be responsible for the payment, if any are due, or taxes or 
assessments pursuant to the law of the State of New York, the laws of the United States 
or any other governmental agency.

The Leader shall, as the agent of the purchaser, enforce disciplinary measures for just 
cause and carry out instructions as to selections and manner of performance.  The 
agreement of the performers to perform is subject to proven detention by sickness, 
accidents, riots, strikes, epidemics, acts of nature, or any other legitimate conditions 
beyond their control.

No performance of this engagement shall be recorded or reproduced from the place of 
performance in any manner or by any means whatsoever in the absence of specific written 
permission from the Artists Representative.

The Purchaser (person, firm or corporation) unequivocally acknowledges and represents 
that there does not exist against him in favor of any performer or group of performers 
any claims of any kind arising out of musical and /or entertaining services rendered for 
such Purchaser during the past five years.

The Purchaser shall provide a reasonable space within the venue for the sale of the 
Leader’s merchandise (compact discs, tapes, T-shirts, hats) at a price to be determined 
by the Leader.

If the Purchaser breaches this Agreement, he shall pay to the Performers: (a) the full 
amount of the contracted price stated herein; (b) six percent (6%) interest thereon; and  
(c) reasonable attorney's fees.  This contract shall be construed and interpreted under 
and in accordance with the laws of the State of New York.  It is expressly understood 
that the Artist(s) executes the agreement as an "independent contractor" and is not an 
"employee" of the Purchaser.
